It depends on whether the mobile home still has a certificate of title. In Florida, a mobile home can be titled through the Department of Highway Safety and Motor Vehicles, while the land under it is conveyed by deed. A deed to the land alone does not by itself transfer a home that is separately titled.
Mobile Homes with a Title
When the home has an active title, ownership of the home transfers through that title, and ownership of the land transfers by deed. A sale of both the home and the land usually involves both documents.
Retiring the Title
A mobile home permanently affixed to land can have its title retired so it is treated as part of the real property (section 319.261). The statute applies when the owner of the home also owns the land, or holds it under a recorded lease of 30 years or more. The owner records the original title, the legal description of the land, and a sworn statement with the clerk of the circuit court, and then applies to the department to retire the title. After that, the home passes with the land by deed.
Checking the Status
County records and the department's title records show whether a home's title has been retired. Title retirement is handled through the department and is a separate step from preparing a deed, so its status is usually confirmed before a transfer.
