Lady Bird Deeds

Is a Lady Bird Deed vs. Lady Bird Trust?

Is a Lady Bird Deed the same thing as a Lady Bird Trust? No, they are not the same. A Lady Bird Deed is a special type of real estate deed that transfers only one piece of Florida property after you pass away.

The term "Lady Bird Trust" is a common online misnomer, and usually refers either to a regular revocable living trust or to the enhanced life estate concept built into the deed itself.

For most people who own just one property, a Lady Bird Deed is simpler, faster, and much less expensive. A full revocable living trust can hold multiple assets and give you even greater control, but it is not required if your only goal is to pass the house without probate.
