Since January 1, 2024, Florida section 695.26 has required the post office address of each witness to be printed on any instrument that conveys, assigns, encumbers, or otherwise disposes of real property or an interest in it. The witness's name must also be printed beneath the witness's signature. The clerk of court may not record a covered instrument that is missing this information.
What Section 695.26 Requires
For a covered instrument to be recorded, it must show, legibly printed, typed, or stamped:
The name of each person who signed it, beneath the signature, and that person's post office address.
The name and post office address of the person who prepared it.
The name of each witness, beneath the signature, and the witness's post office address.
The name of the notary, beneath the notary's signature.
For deeds and other conveyances except mortgages, the name and post office address of each grantee.
A 3 inch by 3 inch blank space at the top right of the first page and a 1 inch by 3 inch space at the top right of each later page.
The clerk may accept a name or address in a different position if the connection to the signature is clear.
Which Documents Are Covered
Any recorded instrument affecting title to Florida real property, including deeds, easements, mortgages, assignments, and lien releases. Florida deeds and easements must be signed before two witnesses, so they always need witness addresses. Other covered documents need witness addresses only if they have witnesses.
Exceptions
The rule does not apply to instruments signed before July 1, 1991, court orders and judgments, wills, plats, documents prepared by public officers other than notaries, or instruments signed or acknowledged outside Florida.
Practical Tips
A street address or a post office box works. The statute calls for a post office address.
Print addresses clearly beneath or next to each witness signature.
A document rejected for a missing address must be corrected and resubmitted, which delays recording.
